Islamabad High Court Rules on FIR Jurisdiction Disputes

The Islamabad High Court has issued a significant ruling regarding the jurisdiction of First Information Report (FIR) filings, emphasizing the importance of legal boundaries in criminal cases. The ruling came in response to a plea against the registration of cases in different regions against former Interior Minister Sheikh Rashid for an incident at Islamabad Polyclinic.

Justice Tariq Mehmood Jahangiri of the IHC highlighted the role of constitutional courts in protecting citizens' rights. The court's detailed verdict, spanning 41 pages, led to the dismissal of cases registered in Karachi's Mochkaa and Lasbela police stations against Sheikh Rashid for remarks made about Bilawal Bhutto, as the incident occurred in Islamabad.

The court reiterated the legal principle that individuals cannot face multiple prosecutions for the same offense, emphasizing the need for cases to be filed within the appropriate jurisdiction. It also condemned the trend of filing baseless cases against political opponents, labeling it as a violation of established laws.

In a separate case, a complaint against Sheikh Rashid for offensive language against the PPP chief was dismissed, with the court expressing concern over the misuse of legal processes for political harassment. The judgment underscored the responsibility of constitutional courts to uphold democracy and the rule of law, emphasizing the need for adherence to legal principles and jurisdiction.

Referencing a Supreme Court case, the judgment reiterated that incidents occurring in Islamabad cannot lead to FIRs being filed in other provinces, stressing the importance of legal jurisdiction and the prevention of multiple filings for the same offense.

The Islamabad High Court's ruling serves as a reminder of the significance of legal boundaries in criminal cases and the protection of citizens' rights.
