Supreme Court of Pakistan Stresses Accountability in Broadcasting

The Supreme Court of Pakistan recently underscored the importance of accountability in cases of broadcasting slander. Chief Justice Qazi Faez Isa emphasized that those who spread defamatory material cannot evade responsibility by claiming they are not the originators of the slander. The court highlighted that disseminating such content not only damages the reputation of the target but also negatively impacts those who consume it. It was made clear that verifying the truth of information before broadcasting is crucial, as freedom of speech does not justify slander.

In a notable incident, Senator Faisal Vawda and MQM MNA Mustafa Kamal issued apologies for making contemptuous remarks during press conferences. While they admitted their error and sought forgiveness, the TV channels that aired these conferences received show-cause notices from the court. The channels' argument that broadcasting such content serves the public interest was rejected, with the court emphasizing that intent to harm is not a prerequisite for contempt proceedings.

The court also highlighted the necessity of balancing freedom of speech with respect for individuals' dignity and privacy. Expressing concern over the prevalence of falsehoods and slander in public discourse, the court warned about the harmful effects on society. It was emphasized that spreading lies can lead to polarization, hatred, and even conflict.

Recognizing the challenges posed by the rapid spread of misinformation, the court called for increased caution in sharing information. It cautioned against the destructive impacts of deception and disinformation on relationships, institutions, and global stability. Emphasizing the significance of accountability, the court stressed the need for measures to discourage defamation and falsehoods.
