Justice Athar Minallah highlights concealed truth in judicial interference case

The Supreme Court of Pakistan has resumed hearing a significant suo motu case concerning allegations of interference in judicial matters, with Justice Athar Minallah highlighting that the truth had been concealed for 76 years. The case revolves around a letter written by six Islamabad High Court judges accusing the country's security apparatus of meddling in judicial affairs. Chaired by Chief Justice of Pakistan Qazi Faez Isa, a six-member bench is overseeing the proceedings, which are being broadcast live on the SC's website and YouTube channel.

The letter from the IHC judges to the Supreme Judicial Council raised concerns about pressure on judges, including allegations of abduction, torture of relatives, and secret surveillance in their residences. Following calls for an investigation, an inquiry commission was established with the approval of the federal cabinet. Former CJP Tassaduq Hussain Jillani recused himself from leading the commission, urging Justice Isa to address the issues internally.

The SC, taking suo motu notice of the situation, is also reviewing over 10 petitions and applications from various bar associations. The IHC and Lahore High Court have taken steps to combat alleged interference, with the Peshawar High Court proposing legislation to define the role of intelligence agencies. The SC has directed petitioners to submit responses, with the federal government and intelligence agencies expected to reply through the attorney general of Pakistan.

During the hearing, Justice Minallah stressed the gravity of the matter and called on the federal government to clarify its stance. The Pakistan Bar Council recommended the establishment of a judicial commission to investigate the allegations and uphold the judiciary's integrity.
