The Lahore High Court has referred a case challenging the Election Commission of Pakistan's authority to withdraw election symbols to a larger bench. The petition argues that such actions are unconstitutional, emphasizing the importance of upholding fundamental rights in electoral processes.

The Lahore High Court (LHC) has decided to refer a case regarding the withdrawal of election symbols from political parties to a larger bench for further examination. This move comes after the government's legal representative informed the court about similar pending petitions awaiting consideration by a larger bench.

The case, brought forward by advocate Azhar Siddique, challenges the Election Commission of Pakistan's (ECP) authority to withdraw election symbols, arguing that such actions are not in line with the constitution. The petitioner argues that the ECP's role should focus on ensuring transparent elections rather than imposing punitive measures.

The petition seeks a declaration from the court stating the withdrawal of election symbols as unconstitutional and null and void. It emphasizes that the right to contest elections under a common symbol should not be taken away, asserting that the ECP, as a constitutional body, does not have judicial authority. Any infringement on fundamental rights by the ECP is considered illegal under Article 8 of the Constitution.

It is worth noting that the Pakistan Tehreek-e-Insaf (PTI) participated in the February 8 elections without an electoral symbol due to a prolonged legal dispute over its failure to conduct intra-party elections.

The decision by the Lahore High Court to refer the case to a larger bench indicates a significant development in the ongoing debate over the ECP's authority to withdraw election symbols. The outcome of this review could have far-reaching implications for future electoral processes in Pakistan, particularly in terms of upholding constitutional rights and ensuring a fair and transparent electoral system.
